Lawsuit filed regarding Nucor deal

A lawsuit has been filed on behalf of the Lincoln Trail Grain Growers Association against Meade County Fiscal Court, Meade County Riverport Authority, Meade County/Brandenburg Industrial Development Authority, Greenland Acquisition Company, Inc., Nucor Corporation, and Consolidated Grain and Barge Co.


The lawsuit, filed Thursday, seeks to void certain actions of the Meade County Fiscal Court, Meade County Riverport Authority, and Meade County/Brandenburg Industrial Development Authority (collectively, the “Meade County defendants”) relating to a proposal by Nucor Corporation and/or its affiliates to open a steel mill at the Meade County riverport.


The complaint alleges that the defendants have “conducted the Nucor transaction in a manner that has violated certain statutory and constitutional laws.” As a result of these actions, the complaint alleges, the Meade County defendants have reached a proposed deal with Nucor which threatens irreparable harm to the grain farming community and other matters of public interest in and around Meade County.


The Lincoln Trail Grain Growers Association seeks a declaration that the Meade County defendants’ actions violated the Kentucky Constitution, the Open Meetings Act, and other applicable Kentucky law. They are asking the Court to declare the Nucor transaction unlawful and void and enjoin any acts in furtherance of the Nucor transaction, according to the complaint.


A motion hour is scheduled for 1 p.m. on Jan. 9 in Meade County Circuit Court.
